CITATION
In re: Estate of Jacob Kreider, deceased
In the Orphans' Court of Lebanon County No. 3, February Term, 1949 COUNTY OF LEBANON, SS: THE COMMONWEALTH OF PENNSYLVANIA

To the children of Jacob Kreider, deceased, their heirs, executors administrators and assigns.

WHEREAS, Elmer H. Dutweiler and his wife, Edith M. Dutweiler, Lester R. Shoop and his wife, Alverta I. Shoop, John S Bowman and his wife, H. Evelyn Bowman, presented their petition to the above-named Court setting forth that Jacob Kreider, late of the Township of South Annville, County of Lebanon and State of Pennsylvania, deceased, died prior to July 11, 1870. leaving to survive him as his only heirs a widow, Mary Kreider, and the following children: Joseph L. Kreider, Henry L. Kreider, William L. Kreider, Benjamin Kreider, Abraham L. Kreider, Sarah Kreider, being the owner of, inter alia two tracts of real estate, one of which tracts was situated in the Township of South Annville, Lebanon County, Pa., containing 55 A. and 93 P., and the other tract being situate in North Annville Township, County and State aforesaid, containing 16 A. and 40 P., which tracts are more fully bounded and described in Orphans' Court Docket of Lebanon bounty. Pa., Vol. 14. Page 616 &c, reference being thereunto had will more fully and at large appear; that in proceedings in parition in the Estate of Jacob Kreider, deceased, the above two tracts of land containing in the aggregate 71 A. and 133 P. were awarded to Joseph L. Kreider by Order of the Orphans' Court of Lebanon County, Pa., dated November 7, 1870, upon his entering a recognizance for payment of the purchase money, and by the same Order, a dower was charged upon the same premises in favor of the widow of said decedent, Mary Kreider, the interest thereon to be paid to her yearly during her lifetime, and immediately after her death, the principal sum of said dower was to be paid to the other heirs and legal representatives of the said Jacob Kreider deceased; that the said Elmer H Dutweiler and his wife, Edith M. Dutweiler, are the owners of a tract of land fronting 47' on the south side of the Benjamin Franklin Highway, and extending southwardly, of equal width in depth 198' to an alley, which land is part of the aforesaid 71 A. and 133 P., and is more fully described in deed from Reuben W. Kreider et ux to Elmer H. Dutweiler et ux, dated Aug. 12, 1948, recorded In the Recorder's Office of Lebanon County, in Deed Book Q. Vol. 8, Page 657; that the said Lester R. Shoop and his wife, Alverta I. Shoop, are the owners of a tract of land fronting 50' on the south side of the Benjamin Franklin Highway, and extending southwardly of equal width in depth 180.75' to an alley, which land is part of tne aforesaid 71 A. and 133 P. and is more fully described in deed from Frank. W. Blatt to George D. Hartman et ux, predecessors in title to the said Lester R. Shoop and his wife, Alverta I. Shoop recorded in the Recorder's of Lebanon County, in Deed Book L, Volume S, Page 674; that the said John S. Bowman and his wife, H. Evelyn Bowman, are the owners of a tract of land fronting 45' on the south side of the Benjamin Franklin Highway, and extending southwardly 198' to an alley, which property is part of the aforesaid 71 A. and 133 P. and is more fully described in deed from Howard W. Kreider to John S. Bowman et ux, dated Aug. 12. 1948, recorded in the Recorder's Office of Lebanon County in Deed Book Q. Vol. 8, Page 656; that more than 20 years have elapsed since said recognizance and dower have become due and payable; that no payment of principal or interest has been made within 20 years on account of said charges by the present owners or their predecessors in title: that the petitioners do not know the names of any parties interested in said charges; that no sufficient satisfaction, release, acquittance or acknowledgment of payment of paid charges is of record in the Countv of Lebanon: and praying said Court for a decree, releasing and discharging said land owned by the petitioners from said charges and the payment thereof.

WHEREUPON, said Court made an Order dated February 7, 1949, at No. 3, February Term, 1949, awarding a citation, directed to you requiring you to appear in said Court on Monday, March 21, 1949 to show cause why the said land should not be discharged from the lien of said charges:

NOW. THEREFORE, you are hereby cited to be and appear before our- said Court on Monday, March 21, 1949, at ten o'clock in the forenoon of that day, and show cause, if any you have, why said land- should not be discharged from the lien of said charges. And therein fail not at your peril.
